Should You Wait Until a Divorce is Final to Buy a House?

If you are looking to buy a house before the divorce between you and your soon-to-be-ex is final, take a minute to reconsider. Purchasing a house before the divorce is finalized will add a lot more chaos to the divorce because, even though you are buying it yourself, the house could potentially become a marital asset. If the house does become part of the marital estate, that would make things really messy when dividing the assets between the two of you.

Even if the divorce is amicable, there could still be some hurt or angry feelings and trying to buy a house before the divorce is final presents a spouse the opportunity to cause trouble. Be patient and be smart. Divorces are hard enough so why through a wrench into things? Couples already have a difficult time dividing their assets so leaving a major one out, or even if it isn’t considered a marital asset then leaving the trouble out altogether, will make things a little bit easier to handle.

To save yourself the headache, you should wait until the divorce is final before purchasing a house. You may have to wait a little longer, but it is better to wait than to have to deal with the legal ramifications of having to divide a new house bought in your name when you are dividing the marital assets.
